Simon Cowell and Cheryl Cole may have buried the hatchet over the media mogul's part in the decision to axe her but it could all come to a head following the reports that Simon may have to testify against Cheryl in her lawsuit against the X Factor USA.

Following the reports last year which suggested that Cheryl was suing the show's bosses for 1.4 million in unpaid fees, the Metro have reported that production company Blue Orbit have placed Simon is at the top of the witness list.

Speaking of the case that could go to court last year, a source told The Sun:

"Everyone is surprised by the lawsuit. No judge would be paid for a season they didnt appear on."

A rep for Cheryl and a rep for Simon have been approached for comment.

Meanwhile, whilst Cheryl may have ruled out a return to the X Factor, Simon Cowell recently hinted that he would like to return to the UK version of the show.

Talking to Hello magazine, the media mogul who will be returning to our TV screens for the new series of Britain's Got Talent, said:

"It's been difficult the last two years not being on the show as I always had a great time and the last time that I did do it, it ! was such a brilliant year.

"So at some point of course I'm going to come back and do the show.
