The legal team for Cheryl Cole will attend court for the first time next month since it was announced the singer plans to sue US X Factor for 1.4million.

Cheryl launched the case after the she was unceremoniously dumped as a judge in June 2011, after just a few days in her new position.

According to the Sunday Mirror things could become both explosive and expensive as the shows producer Blue Orbit strenuously deny the claims.

Blue Orbit originally paid Cheryl 1.2million despite her very brief appearance on the show but the Call My Name singer is demanding 1.34million for the second season, 200,000 for expenses and interest on top of that.

A US legal source told the Sunday Mirror: The gloves are really off in this one. If Cheryl had any illusions Blue Orbit were going to roll over and give in to her demands, they have been well and truly shattered.

Her team will appear in the Superior Court of Los Angles next month and will reportedly attempt to convince Judge Abraham Khan that the case should go before a jury.

If the judge does agree to this, Cheryl will have to pay her own legal bill, other costs she may incur and possibly even compensation if it turns out to be failed claim.

The source added to the paper: This is a risky game for the singer. The stakes are high, but she must feel she has a strong case.

In papers filed by Blue Orbit it claims Cheryl lacks standing in the case however in one section it does say the firm made a mutual mistake in the contract.

The case could end up involving Simon Cowell, former judge Paula Abdul and short-lived host Steve Jones.

In December of last year it was revealed that the singer, who was furious when Simon Cowell dumped her after just three weeks, without telling her personally and before the show ever aired, planned to take the case to court.

The 11-page lawsuit filed at the time says she was paid her 1.1million salary for season one but that the producers still owe her 1.25million for the shows second season plus a 62,000 wardrobe allowance, a 15,500 stylist allowance, a 9,300-a-month living allowance and 1,550-a-month living expenses.

Cheryl was hired in April 2011 but by May she was out amid claims the US audience struggled with her Geordie accent. In addition to lost pay, Cheryl wants Blue Orbit Productions to reimburse the cost of bodyguards and the first-class flights she took to LA as well as flights for members of her entourage.

The singer may now have reconciled with the music mogul but at the time she was devastated about being replaced by Nicole Scherzinger.

She wrote in her tell-all book: Simon didnt even have the guts to phone or send a message warning me what was coming. I was furious ... I believed we had a good friendship and I couldnt understand why he hadnt been straight with me.

She also texted the music mogul saying: I hate you. I understand youre a businessman and what Ive learned from this is that business means more to you than our friendship.
